Terms and Conditions

This page (together with the documents referred to in it) tells you the terms and conditions on which we supply dog registration documents, event and judges licenses and membership certificates documents (“Services”) listed on our website www.ikc.ie to you through our online ordering service. Before proceeding to place an order, we ask that you read the terms and conditions carefully. By ordering our Services through this website you agree to be legally bound by and act in accordance with these terms and conditions and by all other applicable provisions. If you disagree with these terms and conditions and/or any other applicable provisions, you are not permitted to, and agree not to use this website. We reserve the right to amend these terms and conditions.

1. General Information

The Irish Kennel Club Limited (“IKC” or “we” and “Us” or “us” and “our”) of Fottrell House, Harold’s Cross Bridge, Dublin 6W, Ireland a copy registered in Ireland under company number 112543, provides this website www.ikc.ie (“our Website”). 2. Your Status and Conditions of Use

By placing an order on our Website, you warrant that you are legally capable of entering into binding contracts and are at least 18 years old. 

You will ensure that your responses are not misleading or inaccurate and you acknowledge that we are reliant upon you to complete the order form correctly.

3. How the contract is formed between you and us

You may place an order on this website for our Services by using our online ordering service or our merchandise order form. In using our online ordering service or our merchandise order form, you will be:

  • Asked to provide all details outlined on the online registration form, application form for a license, application form for a certified pedigree, application form to register a prefix/affix or application form for membership and confirm your acceptance of these terms and conditions;

     

  • Asked to input your credit card details or to process your payment through Realex and complete the placing of your order; and
  • On fulfilling each of the above requests, given confirmation that your order has been placed and a reference number in respect of your order.
  • After placing an order, you will receive an e-mail from us acknowledging that we have received your order (the Order Notification). Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us for a Service. All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an email to the email address that you supply to us when your request for our Service has been confirmed (“Confirmation”). The contract (“Contract”) will only be formed when we send you Confirmation. Payment will be taken from your credit card when you place your order. If your order is not accepted by us, payment will be refunded to your credit card. All Contracts will be concluded in English. If your order is accepted by us, you should receive Confirmation no later than 25 days unless it is affected by Events Outside Our Control (as defined in paragraph 7 below.).

4. Description and pricing

All of the prices for our services on our Website are listed inclusive of VAT but do not include delivery costs.

A description of the Services ordered and the price of those Services, together with details of all applicable taxes and delivery costs and arrangement for payment for delivery of the Service will be included on the order form screen for your review before you finalise the placement of the order with us.

5. Your Payment Security

We have made security a priority for our members. All payment transactions are made through Realex Payments. We do not accept payments through PayPal.

We do not process payments in respect of the Services nor do we retain payment information. Realex Payments process your payment by credit or debit card. For more information on Realex Payments please see www.realexpayments.com

You will be charged an administration fee of €1.50 per credit/debit card transaction.

6. Security of collected data

The cardholder is responsible for any website transactions. We intend to protect your Personal Data and to maintain its quality. We will use all reasonable efforts to take all appropriate technical and organisational measures and precautions to keep Personal Data secure and protected from unauthorised access, use or alteration and unlawful destruction. Measures include using Secure Sockets Layer (SSL) encryption when collecting or transferring sensitive data, such as credit card details. SSL encryption is designed to make the data unreadable by anyone but us. We use Realex Payment (www.realexpayments.com) to process your payments.

7. Right to cancellation and refund

You have the right to cancel the Contract without penalty and without the need to give us any reason at any time during the period of fourteen days (“the Cooling off Period”) beginning on the day after you receive the Confirmation. To cancel a Contract, you must send us notice in writing to the Contact Details below. You should ensure that you include the Payment Reference Number sent with your Confirmation and your contact details including your address and telephone number. If you do decide to cancel the Contract, you will be required to return all the original documentation to us at your own cost before a refund is issued to you.

In the event that you cancel a Contract, we agree to reimburse you the purchase price that you have paid for the Services, less the administration charge of €1.50 and within 14 days of receipt of the original documentation by the IKC using the same means of payment that you used for the original transaction.

8. Delivery methods and timing of delivery

We will arrange to send documents in respect of the Service that you have requested to you at your registered address via post or by email where appropriate. If the documents are sent by post, please allow 3-7 working days from the date of Confirmation for delivery within the Republic of Ireland. If the Document(s) are sent by email, please ensure that you check your SPAM folder if you do not receive your Document(s) by email within 1 hour from the receipt of Confirmation.

9. Events Outside Our Control

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these terms and conditions that is caused by an Event Outside Our Control.

An Event Outside Our Control means any act or event beyond our control, including without limitation strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat of preparation for war, fire explosion, storm, flood earthquake, subsidence, epidemic or other natural disaster or failure of public or private telecommunications networks.

If an Event Outside Our Control takes place that affects the performance of our obligations under these terms and conditions we shall contact you as soon as reasonably practicable to notify you and our obligations under these terms and conditions shall be suspended. You may cancel the Contract if an Event Outside Our Control takes place and continues for 30 days after the date of Confirmation.

We aim to provide you with a quality service. If, however, you feel that you have cause to complain, you can contact us at the Contact Details below. We will try to do our best to solve any problems that arise.

12. Privacy Statement

13. Termination

We shall have the right to terminate the Contract forthwith in the event that you act in breach of your obligations under these terms and conditions.

14. Law

These Terms are governed by Irish law. This means a Contract created through our site and any dispute or claim arising out of or in connection with it will be governed by Irish law, and the parties hereby submit to the exclusive jurisdiction of the Irish Courts.

15. Severability

Notwithstanding that the whole or any part of any provision of these Terms and Conditions may prove to be illegal or unenforceable the other provisions of the Terms and Conditions and the remainder of the provision in question shall remain in full force and effect.

16. Interpretation

Words importing the singular include the plural, words importing any gender include ever gender and words importing persons include bodies corporate and unincorporated; and (in each case) vice versa.

The headings to the Terms and Conditions are for ease of reference only and shall not affect the interpretation or construction of the Contract.

17. Payment Card General Information

My credit/debit card was declined while trying to order online, what will I do?
If your credit or debit card transaction was declined, please try ordering again using another card. For details on why your card was refused, please contact your card provider.

When will my credit card be charged?
When you confirm your order/payment details via the Realex secure server, money is debited from your card. Your card details are not stored by our system, nor are they ever seen by us. Your card information is processed through the Realex an Irish based processing company using the most current security technology to keep your payments secure.

What payment methods does IKC accept?
Customers can pay for purchases using most major credit or debit cards, including MasterCard, Visa credit card, Visa debit card, Maestro and Discover. We do not accept PayPal.
