Introduction

The Irish Kennel Club Limited (“IKC” or “us”) respects your privacy. This Privacy Statement sets out the basis on which we process any personal data we collect from you, or that you provide to us. This Privacy Statement is designed to protect you, our users, by informing you what information we collect, what we do with that information, with whom we share it, and the methods we use to collect it. IKC is proudly committed to complying with the Data Protection Acts 1988, 2003 and 2018 (“the Acts”) which incorporate the General Data Protection Regulation (GDPR) and the “Law Enforcement Directive” (Directive (EU) 2016/680) in addition to the the 2011 “ePrivacy Regulations” (S.I. No. 336 of 2011 – the European Communities (Electronic Communications Networks and Services) (Privacy And Electronic Communications) Regulations 2011).

Information we collect

As a user of our Website, you may give us information about you by filling out forms for example by applying for membership; registering a dog, litter of puppies, an overseas dog; applying for a licence; completing a field trials entry form; registering a pedigree; purchasing merchandise, payment for services that we provide in which case we will require certain personal data from you. You may also give us information by corresponding with us by post, email, and telephone or otherwise. This information may include your personal data such as your name, address, email address, mobile or landline telephone number, gender, date of birth and personal description. Debit/Credit card information is processed by our 3rd party provider, Realex.

Your payment card details are not retained on this site. Before entering your payment card details on our site, you are re-directed to Realex Payments, a secure online payments provider, where you will be required to enter your card details to complete payment. Realex Payments are compliant with the highest level of Payment Card Industry Data Security Standard (“PCI DSS”). PCI DSS is an industry-wide set of requirements and processes to help ensure that cardholders can make purchases confident in the knowledge that their credit card information will be protected. All information that is transmitted to Realex Payments over the internet is protected to ensure confidentiality. Cardholder information is encrypted and hashed when stored on Realex Payments systems and is not displayed in their reporting systems.

Purpose for which we collect information

IKC will use the personal data supplied by you for the purpose for which you have supplied that information (i.e. for the purpose of registering a dog etc.) and to notify you about any changes to IKC. If you have provided debit/credit card details, these will only be used for the purpose of providing the services that you have requested. Personal details will be used only for the purpose you requested.

If you decide that you no longer wish to receive promotional information, you can contact us by using the contact details below and we will remove you from our mailing list. Please note, however, that we cannot backdate any changes that you make.

Lawfulness of processing

There are six alternative ways in which the lawfulness of a specific case of processing of personal data may be established under the GDPR.
It is IKC’s policy to identify the appropriate basis for processing and to document it, in accordance with the regulation. The options are described in brief in the following sections.

1. Consent
Unless it is necessary for a reason allowable in the GDPR, IKC will always obtain explicit consent from a data subject to collect and process their data. Transparent information about our usage of their personal data will be provided to data subjects at the time that consent is obtained and their rights with regard to their data explained, such as the right to withdraw consent.

2. Performance of a Contract
Where the personal data collected and processed are required to fulfil a contract with the data subject, explicit consent is not required. This will often be the case where the contract cannot be completed without the personal data in question e.g. a delivery cannot be made without an address to deliver to.

3. Legal Obligation
If the personal data is required to be collected and processed in order to comply with the law, then explicit consent is not required. This may be the case for some data related to employment and taxation for example, and for many areas addressed by the public sector.

4. Vital Interests of the Data Subject
In a case where the personal data are required to protect the vital interests of the data subject or of another natural person, then this may be used as the lawful basis of the processing. IKC will retain reasonable, documented evidence that this is the case, whenever this reason is used as the lawful basis of the processing of personal data.

5. Task Carried Out in the Public Interest
Where IKC needs to perform a task that it believes is in the public interest or as part of an official duty then the data subject’s consent will not be requested. The assessment of the public interest or official duty will be documented and made available as evidence where required.

6. Legitimate Interests
If the processing of specific personal data is in the legitimate interests of IKC and is judged not to affect the rights and freedoms of the data subject in a significant way, then this may be defined as the lawful reason for the processing. Again, the reasoning behind this view will be documented.

Use of your information by third parties

IKC does not sell or pass your personal details to third parties without your consent, except in the following instances:

We employ other companies and individuals to perform functions on our behalf such as our hosting provider, our payment processing service provider, delivering packages, analysing data, providing marketing assistance and designing and operating our website, providing legal advice. Such companies and individuals have access to your personal information for the purpose of carrying out this work only. These enterprises will not use your data for any other purpose.

Where it is required by applicable law or pursuant to a court order or similar order;
Where it is required urgently to prevent serious loss or damage to property of IKC;
Where it is required for the purposes of obtaining legal advice or for the purpose of, or in the course of, legal proceedings to which the IKC is a party or a witness.

Our Website may, from time to time, contain links to and from third party websites. You may request access to, rectification, erasure or restriction of your Data, or object to the processing of your Data or Data portability at any time. We will respond to your request in writing as soon as practicable and in any event within one month of receipt of your request. We may request proof of identification to verify your request. Security and where we store your personal data

We are committed to protecting the security of your Data. We use a variety of security technologies and procedures to help protect your Data from unauthorised access and use. We cannot guarantee the complete security of our database, nor can we guarantee that information you supply will not be intercepted while being transmitted to us over the Internet. We have implemented strict internal guidelines to ensure that your privacy is safeguarded at every level of our organisation. We will continue to update policies and implement additional security features as new technologies become available.

Although we will do our best to protect your Data, we cannot guarantee the security of your Data transmitted to our Site. Any transmission of Data is at your own risk. Once we receive your Data, we will use appropriate security measures to seek to prevent unauthorised access or disclosure.

IKC reserves the right to amend this Privacy Statement at our discretion.
